I have just found out that the computer someone built for me has a pirated copy of XP on it and I want to install a legit copy?  Do I need to format my hard drive or is there a way I can uninstall the old one and reinstall the new one without losing all my files.

I think microsoft said that they will forgive initial illegal install if you buy a copy and run a repair install.
If you buy a copy, boot to the cd and choose to run a repair install, it will change several things , including the serial number. It will than ask to activate. Worst case, you call the 800 number and say you had to do a repair install and it will not reactivate . They then will ask for the serial number, tell you what files to delete and then allow it to contect and activate.
